I think its interesting how Google seems to not care about staying within the DMCA safe-harbors.
As mere conduits of information, provided they follow the DMCA take-down procedures and meet a few other wickets, they can be free from liability of copyright infringement.
Previously, the strayed from the safe-harbor when they (google play) began taking down Flappy Bird knock-off's on behalf of the flappy bird creator (active policing can take you out of safe harbor).
Now, they seem to perform a fair use legal analysis on behalf of the content providers.
I think Copyright Law is in desperate need of overhaul. I guess Google thinks so too and is purposefully flaunting the law to do what it thinks is right, which is kinda awesome, regardless of which side I stand of if they are right or wrong.
