The law matters. Castration is cruel and unusual.

Repealing one of the first ten amendments leaves the courts with a precedent to repeal the others, and allows the pork to violate pretty much anything in those repealed amendments.

The supreme court cannot create laws, only interpret them. If they want to allow castration of criminals they better pass an amendment to get rid of the 8th first, otherwise its completely unconstitutional.

Also they did know that there would be terrorists, they practically were terrorists.

Terrorism typically targets civilians more than governments. That's the difference between revolutionary and terrorist imo at least.

No. We have the amendment process for making adjustments. The Supreme Court is only to interpret what is already written, not magically add in new things.

As Jon Stewart once said, define cruel and unusual. Death by mind-blowing sex is unusual, but is it cruel? Death by car accident is cruel, but is it unusual?

Cruel and unusual is subjective, and subject to interpretation.

In England today death would be considered both unusual and cruel, whilst less than a hundred years ago it was considered completely normal and fair.

No, you should not castrate rapists.

Tests were once done in the Netherlands, when rapists were castrated, and there were generally 3 groups of people.

1. People who simply stopped (the group of people, under his belief, everybody should fall under)

2. People who sexually abused people in other ways

3. People who violently beat others as a replacement for rape

What was concluded, was that people don't rape for the sex. They do it for a feeling of empowerment, and the fact that they want to be in control of something, or someone, and feel the need to abuse them in horrible ways. If you castrate them, they will simply find alternatives to rape.

Therefore, castrating is not the option. I'd rather the choice for optional castration, but if the person is psychologically damaged, then a life sentence.

And what will you do to the woman rapists?
