@Aura, nope not the case. You can test it by making a 'mock' level to see for yourself. The Bosses, just make that territories theres. HOWEVER, maybe it can't take the place of a special unit? aka a Commander!
BINGO! The boss can't take the spot of a commander. And Mod's template has..... 3 commanders! Such great odds^^ LoL... now someone can work out the odds for getting less then 4 clones :)

EDIT: More testing, the Boss can't clone on a boss spot.
EDIT: a CLONE will never spawn in a way that eliminates a player. Nor will a clone spawn on the territory the Boss died on (e.g where he stood before attacking)
So a Boss will never spawn in its original spot. Never spawn on a Commander, or a boss spot. Never spawn on the last territory of a player. Hence.... it is that one very small chance of no clones in MoD's level. Since it is precisely 4 places the boss can't spawn on.
