2) There is a set Terms of Service
Which means you have no ownership over the software since you did not puchase it, therefore you're subject to the ToS first and foremost, since Dan(iel Church) is the sole owner. The ToS says specifically this:
6) THIS SOFTWARE IS SUBJECT TO CHANGE AT ANYTIME WITHOUT WARNING.
(...)
8) THIS SOFTWARE DOES NOT PROVIDE ANY WARRANTY.
In fact, this too:
2) THIS SOFTWARE MAY NOT BE DISTRIBUTED UNDER ANY CIRCUMSTANCES.
3) THIS SOFTWARE MAY NOT BE MODIFIED UNDER ANY CIRCUMSTANCES.

5) THIS SOFTWARE MAY ONLY BE USED IN PRIVATE.
(...)
10) IF YOU AT ANY POINT DECIDE TO BREACH A CONDITION, YOU MUST REVERT YOUR ACTIONS.
Which means
he is the one who can file a lawsuit on you for 1) modifying to your desire 2) distributing your modification 3) not using it in private and 4) not reverting your actions.
Also - He's not based in the US, so laws can work differently.
