I'm not quite sure what you're getting at here. I looked at the article and it looks like:
1. This is a bill proposed in the California legislature by an elected representative
2. The bill doesn't even ban straws
3. It only applies to sit-down restaurants
4. People who want straws can just request them
5. It's got some ridiculous penalties ($1000 or jail time), but the guy proposing it says they're for shock value and doesn't plan on them becoming part of the law even if the bill passes
I don't agree with these restrictions on plastic straws (or really, I just don't want to deal with them- but I live in Texas so it's not like this matters in my life). However, it seems to me that the only impact this would have even in the world where it passes is the waitstaff now having to ask you, "Sir/madam, would you like a straw for your drink?" Or just having a thing on your table filled with plastic straws for you to take one out if you so choose.
Was the "dictatorship" part intended to be sarcastic? 'Cause this just seems like normal democratic (little d) business to me. An elected guy proposing a bill into an elected legislature that, if passed, will create some tiny, meaningless correction for a market externality that anyone who cares can easily circumvent with no penalty beyond a little bit of social interaction or just moving your hand.
Are you going for some slippery slope fallacy thing here where this eventually snowballs into public executions? Like, for not taking a reusable bag to carry your Whole Foods sustainable gluten-free tilapia and unvaccinated drinking vinegar?
I'm not really concerned with the US government becoming a dictatorship personally, but if I were I think there's a lot of other stuff I'd look at before fretting about a "plastic straw ban" bill that's not even going to ban plastic straws.
