Can't donate due to the crazy ongoing currency exchange rates but I wish this works out for you and Warzone. As a dinosaur in this site I wish nothing but the best and as untrustworthy as I'd deem justice systems, I'd trust you have a good case here.

I don't wanna kill the mood here, but a lot of you are being REALLY dramatic. Judging by the articles on this, the WORST POSSIBLE OUTCOME is... nothing. They're suing to be able to use the name without paying Fizzer royalties or whatever. If they win, both games continue to be called Warzone and neither side pays the other.

If the information in the articles is false, by all means tell me, but this seems like a very small deal.

They're suing to be able to use the name without paying Fizzer royalties or whatever. If they win, both games continue to be called Warzone

It has nothing to do with royalties. If they get the trademark, they can go to Apple + Google and say "Hey this app is named Warzone, and we have the registered trademark for Warzone, please delete the apps" and then poof, Warzone is gone. I had no choice but to oppose the trademark.

Yes, this is another trademark lawsuit and it's usually very boring, but this lawsuit, in particular, is interesting because Activision seemingly isn't saying that the Warzone.com shouldn't exist, but that a complaint filed by Randy Ficker, the developer of the Warzone.com game is "baseless".

However, it was not Activision that took action against the operator of Warzone.com, but the other way around. Warzone.com issued a cease and desist notice to the company behind Call of Duty in 2020 to counter their application for trademark registration.


None of these articles support that narrative. At least as far as the reporting has gone, they're not trying to stop you from using the name, only argue that their game doesn't violate your trademark. It seems like it does, obviously, but I think this situation is being massively misrepresented by either you or all media sources, and I'd be interested in seeing where that breakdown comes in.

If Fizzer wins and gets the trademark for Warzone, if Activision still wants to use the name Warzone for CoD, they would have to pay royalties to Fizzer, and that's assuming Fizzer would even allow Activision to continue using the name.

um, those royalties will be very very juicy...

Idk why Fizzer never trademarked the term when he first changed the site name... or am I wrong? I guess he didn't see a billion dollar franchise coming out of noweher with the same name 3 years on...

This is Very similar to when Sierra released Hero’s Quest in 1989 and had to later change the name because Milton Bradley already had a board game Hero Quest. Sierra had to change the name to Quest for Glory.
They settled out of court.

So i think one of the biggest things here is "Activision further attacks the defendant's claims by pointing out there are 16 other mobile games with the word "Warzone" in the title, and noting "the term 'Warzone' is a phrase that is used by many video games and other entertainment products that involve military combat."

So if Activision is stating in their lawsuit there are already a number of apps with the name Warzone, how the fuck are they arguing that the TM belongs to them. Like their defence for having this lawsuit is that there are already a number of games inclduing yours which use the name, but then argue that they deserve the name after coming last to the table?
